Q & A

Q: Can associations put restrictions on the rental of units in their building?

A: Homeowner associations can indeed put restrictions on the rental of units in their buildings, and these policies tend to vary greatly between associations.
Some associations put no restrictions whatsoever on rentals, while others try to keep them as low as possible or prohibit them completely.
Why would a building want to limit the number of rentals? For one, renters are (perhaps unfairly) thought to be less likely to take care of the property, and owners residing in the building may not want to cohabit with a never-ending stream of renters. However, the option to rent their unit is also highly desired by many owners for the flexibility it provides, so harsh restrictions can ultimately lower the perceived real estate value of units in the building.

Changing Your HVAC Filter

If you have an in-unit HVAC system, now is the perfect time to change your filter to ensure maximum efficiency for the upcoming winter season. Though every HVAC unit is different, this video covers some of the basics of changing your filter:

 

 


Changes to HOA Board Rights in 2017

Recent changes in the Common Interest Community Association Act and the Condominium Property Act formalized the rights of HOA boards to meet privately on particular matters (though such meetings have been standard practice in the industry anyway). The changes go into effect on January 1st, 2017, and allow HOA boards to close any portion of a noticed meeting or meet separately from a noticed meeting in the following cases:

1. To discuss probable or pending litigation.

2. To discuss third party contracts or information regarding appointment, employment, engagement, or dismissal of an employee, independent contractor, agent, or other provider of goods and services.

3. To interview a potential employee, independent contractor, agent, or other provider of goods and services.

4. To discuss violations of the rules and regulations of the association.

5. To discuss member’s or unit owner’s unpaid share of common expenses.

6. To consult with the association’s legal counsel.
